What Is A Power Of Attorney?

  • Purpose: A Power of Attorney allows someone to appoint another person to make decisions for them.
  • Reasons:
    • Temporary Needs: For situations like being abroad or unavailable.
    • Future Planning: To ensure decisions can be made if they lose mental capacity.
  • Types:
    • Ordinary PoA: For short term needs.
    • Lasting PoA: Continues if mental capacity is lost, covering finances or health.
  • Process: Must be registered with the Office of the Public Guardian to be valid.
  • Eligibility: The person appointed must be 18 or over and mentally capable.
  • Revocation: Can be cancelled anytime if the person is mentally capable.
  • Protection: Includes measures to ensure decisions are in the person’s best interest.
