What Is A Probate?

  • Definition: Probate is the legal process in the UK by which a deceased person’s estate is distributed according to their will, or if no will exists, according to the laws of intestacy.
  • Purpose: It ensures that debts and taxes are paid and the remaining estate is distributed to the rightful beneficiaries.
  • Grant Of Probate: If there’s a will, the executor (Person named in the will) applies for a Grant of Probate, which gives them the legal authority to manage the estate.
  • Letters Of Administration: If there’s no will, an administrator (Usually a close relative) applies for Letters of Administration to manage the estate.
  • Process: It involves valuing the estate, paying any debts and taxes, as well as distributing the remaining assets to beneficiaries.
  • Timeframe: The process can take several months, depending on the estate’s complexity and whether any disputes arise.
  • Small Estates: For smaller estates, Probate might not be required if the value is below a certain threshold.
